1. INTRODUCTORY PROVISIONS
1.1. These Terms and Conditions (the “Terms”) govern the mutual rights and obligations between COMFORT PLACE s.r.o. (the “Host”) and natural or legal persons (the “Client”) when providing accommodation services in the Host’s apartments.
1.2. The Host provides accommodation services in apartments located in Spain, offered via www.casadelsol.cz .
1.3. These Terms form an integral part of the accommodation agreement (the “Agreement”), which is concluded when the Client confirms the reservation and the Host accepts it.
1.4. The Agreement and these Terms are governed by Czech law unless stated otherwise.
2. RESERVATION AND PAYMENTS
2.1. Reservation A reservation becomes valid once the Host confirms it and the Client pays a non-refundable booking deposit of 25% of the accommodation price.
2.2. Payment The Client must pay the booking deposit (25% of the accommodation price) within 5 business days of receiving the payment details. Payment is made by bank transfer to the Host’s account.
2.3. Payment confirmation After receiving the payment, the Host sends the Client a payment confirmation.
2.4. Remaining balance The remaining 75% of the total accommodation price is due within two months of the reservation date, but no later than 14 days before arrival.
Once the full amount is received, the Client will obtain the access details to the apartment (see Article 5).
3. CANCELLATION POLICY
3.1. The Client may cancel the reservation in writing at [email protected] .
3.2. Cancellation fees
- Cancellation more than 60 days before arrival: The Client receives a full refund of the remaining balance (the booking deposit is non-refundable).
- Cancellation 14–30 days before arrival: 50% of the remaining balance is charged.
- Cancellation less than 14 days before arrival: 100% of the total accommodation price is charged.
3.3. If the Client fails to pay the booking deposit within 5 business days of receiving bank details, the reservation will not be processed.
3.4. The Host may cancel the reservation due to force majeure (e.g., natural disaster, technical apartment issues). In such case, all amounts paid by the Client will be refunded.
4. APARTMENT RULES
4.1. The Client must follow these rules:
- No smoking in the apartment.
- No loud events; respect quiet hours (22:00–07:00).
- Maximum occupancy must not exceed the number stated in the reservation.
4.2. The Client must keep the apartment tidy and return it in the condition received.
4.3. The Client is liable for any damage caused to the apartment during the stay.
4.4. In case of rule violations, the Host may terminate the stay without refund.
5. SELF CHECK-IN AND CHECK-OUT
5.1. Self check-in After full payment is received, the Host sends the Client an access code by SMS and email.
5.2. Code validity The access code is valid only for the reservation period: from 00:01 on the first day until 11:00 on the last day. After this time, the code automatically stops working.
5.3. Check-in and check-out times Check-in: from 00:01 on the first day of the reservation. Check-out: no later than 11:00 on the last day of the reservation.
5.4. Lost or non-functional code If the Client loses the code or it does not work, the Client must contact the Host immediately at [email protected] or by phone.
6. COMPLAINTS
6.1. If the apartment does not match the description on the website or has other defects, the Client must immediately inform the Host at [email protected] or by phone.
6.2. The Host will handle the complaint without undue delay, but no later than within 30 days.
6.3. Complaints submitted after the stay will not be accepted unless the Client proves that the Host was notified during the stay.
7. LIABILITY AND INSURANCE
7.1. The Host is not liable for loss, damage, or theft of the Client’s personal belongings.
7.2. The Client is liable for damage to the apartment property and must reimburse such damage.
7.3. We recommend that Clients arrange travel insurance covering potential damages or losses.
8. PERSONAL DATA PROTECTION
8.1. The Host processes personal data in accordance with GDPR.
8.2. Personal data is processed to manage reservations and provide accommodation services.
8.3. The Client has the right to request access to, correction, or deletion of personal data.
9. FINAL PROVISIONS
9.1. These Terms are governed by Czech law.
9.2. All disputes between the Host and the Client will be settled by the competent court in the Czech Republic.
9.3. If any provision of these Terms is found invalid, the remaining provisions remain in force.
9.4. These Terms are effective from January 1, 2025.
